These disclosures explain important facts about AXIS Capital ("AXIS," "we," "us," or "our"), our products, and how we are compensated. They are meant to be read alongside our Terms of Use and Privacy Policy. Nothing here is tax or legal advice.
1. Nature of our products
AXIS offers commercial financing products, including merchant cash advances, business lines of credit, equipment financing, and term loans, for business purposes only. These are not consumer credit products, and none of our products are intended for personal, family, or household use. All financing is subject to underwriting and approval.
2. A merchant cash advance is not a loan
A merchant cash advance (MCA) is the purchase of a fixed amount of a business's future receivables at a discount, in exchange for an upfront advance. It is not a loan, does not carry an interest rate, and is priced using a factor rate that sets the total payback amount at the outset. Repayment (the "holdback") is typically collected as a percentage of daily or weekly sales, or as a fixed remittance, depending on the structure you accept. See Merchant Cash Advance and our blog post How does a merchant cash advance work? for a full explanation.
3. AXIS may act as a direct provider or as a broker
Depending on the product and your file, AXIS may fund your business directly, or may act as a broker or independent sales organization (ISO) that places your application with one or more third-party funding partners. When we act as a broker, we may receive compensation from the funding partner that ultimately funds your business. This compensation may vary by product, partner, and deal, and does not increase the amount you owe beyond what is stated in your funding agreement. Any compensation arrangement that applies to your specific offer will be disclosed to you in your agreement before you sign.
4. Figures on this site are illustrative
All amounts, funding speeds, credit-score minimums, worked examples, and figures produced by any calculator or estimator on this website, including the homepage estimator, are illustrative ranges intended to help you understand our products in general terms. They are not offers, quotes, or commitments, and your actual amount, pricing, and speed depend on underwriting of your specific application.
5. Credit inquiries
Submitting an application to AXIS generally triggers a soft credit inquiry only, which does not affect your personal credit score. Some funding partners may require a hard credit inquiry before finalizing an offer or funding. If a hard inquiry is required, we will disclose that to you before it happens and before you accept an offer that requires one.
6. California Commercial Financing Disclosure Law
California law (the California Commercial Financing Disclosure Law and related regulations) requires providers of certain commercial financing products, including some transactions under $500,000, to give specific written disclosures, such as the total cost of financing, the estimated annual percentage rate, and payment terms, at the time a specific offer is extended. If you are a California business applying with AXIS or one of our funding partners, you will receive those required disclosures with your specific offer, before you are asked to sign an agreement. The general figures on this website are not a substitute for those transaction-specific disclosures.
7. State availability
Product availability, terms, and underwriting criteria can vary by state and are subject to change. Not every product described on this site is available in every state or to every business. Availability for your business will be confirmed during the application process.
8. No tax or legal advice
Nothing on this website, including references to potential Section 179 tax treatment for equipment financing, is tax or legal advice. Tax outcomes depend on your specific circumstances and current law. Consult a qualified tax professional or attorney before making a financing decision based on potential tax treatment.
9. Complaints and questions
If you have a question or complaint about an application, an offer, or a funded account, use the contact form at /contact and a member of our team will follow up. We aim to acknowledge complaints promptly and work toward a resolution in good faith.
10. Changes to these disclosures
We may update these disclosures from time to time to reflect changes in our products, partners, or applicable law. Changes are effective when posted to this page, and we will update the "Last updated" date above.
